What elements must be present for liability to be established?

Duty refers the established relationship between the patient and nurse. Breach of duty is failure to perform the duty in a reasonable, prudent manner. Harm has occurred; this does not need to be physical. The breach of duty was the proximate cause of the occurrence of the breach.
